SPECIFIC BACKGROUND AND INFORMATION The California State Water Resources Control Board is proposing to adopt water quality plan for the Lake Tahoe Basin pursuant to Section 13170 of the California Water Code and to Section 208 of the federal Clean Water Act. To the extent of any conflict, any portion the plan adopted by the State Water Resources Control Board will supersede those sections pertaining to Lake Tahoe in the Water Quality Control Plan for the North Lahontan Basin, adopted by the California Regional Water Quality Control Board, Lahontan Region, in 1975. The proposed plan will result in changes in water quality objectivs, additional waste discharge prohibtions, and changes in implementaton measures. In addition, the proposed plan is a draft of the 208 plan the State Water Resources Control Board assumed responsibility for preparing when it ES CONTROL BOARD Clint Whitney Executive Director rejected the Tahoe Regional Planning Agency's original 208 plan inNovember 1978. The hearings scheduled above are to provide an opportunity for public comment before the State Water Resources Control Board prepares and adopts a final 208 plan.

The Tahoe Regional Planning Agency will then be given another opportunity to adopt an acceptable plan. Unless the Tahoe Regional Planning Agency adopts an acceptable plan, the final 208 plan adopted by the State Water Resources Control Bord will be submitted to the Environmental Protection Agency for approval. Water Quality objectives in the proposed plan are based upon those set by the 1975 Water Quality Control Plan for the North Lahontan Region, with some modification clarifying the standards tor tributary streams to reflect the quality 10 be expecta from relatively undisturbed watersheds. Upon approval by the Environmental Protection Agency, the objec tives will have the force of binding standards under stte and federal law. State law authorizes the State Water Resources Control Board to set prohibitions against the discharge of waste.

Waste discharge pro hibiton in the proposed plans would prohibit any discharge of solid or liquid waste to surface or groundwaters in the Lake Tahoe Basin resulting from: subdivisions: development on high erosion hazard land; development not constructed in accordance with land capability; and any new development which is not offset by implementa tion of remedial erosion con trol measures. The proposed plan would also prohibit the discharge of garbage or other solid waste 10 lands within the Lake Tahoe Basin. The proposed implementation program includes the following control erosion and urban runott control projects on public lands; on site surface runoff control measures for areas of intense development or high vehicular traffic; prohibition of further development in critical areas; prohibition of further subdi vision development; Strict controls on the type and intensity of development which is allowed; of erosion from forest lands, especially erosion from dirt roads, timber har vest, and ski area construc: tion and operations. Many of these control measures can be best implemented by local and regional gov: ernment. However, to the extent that other agencies do not make implemtation commitments the State Water Resources Control Board will carryout the plan relying upon authority pro vided by state and tederal water quality laws.

Proposed implementation measures include issuanceof National Pollutant Discharge Elimination System permits for storm sewer discharges, applicable to all persons contributing to storm sewer discharges in the Lake Tahoe Basin, setting conditions requiring compliance with the control measures in the proposed plan. Pursuant 10 the California Environmental Quality Act, Public Resources Code Sec tion 21080.5, Resources Agency as determined that the State Water Resources Control Board's environmental assessment process for water quality control plans is functionally equivalent to the Environmental Impact Report Process. The environmental assessment of the proposed plan has been pre pared in conjunction with, and made part of, the pro posed plan.
