A New York woman is suing Post Consumer Brands for $5 million, claiming that her box of Honey-Comb cereal contained fewer servings than promised on the packaging.
According to court documents obtained by Complex, the woman alleges that the “family box”-sized cereal she purchased was labeled as containing 13 servings. However, she discovered that the box actually had one serving less than advertised.
The lawsuit asserts that if the plaintiff paid $6 for the cereal, she was “deprived of $0.45” due to receiving fewer than 13 servings. Her attorneys argue that this amounts to a “false and misleading” label, rendering the product “misbranded” and causing direct harm to the consumer.
“Plaintiff continues to suffer harm because she cannot rely on the Products’ labeling, including the Representations, for their truth, and thus is unable to determine whether she can purchase the products in the future,” the lawsuit claims.
As of now, Post Consumer Brands has not issued a public response to the lawsuit.
